Recent experience
Gail has been engaged in a number of large scale and document intensive cases before the English High Court, often involving investigation and ancillary proceedings in other jurisdictions. Examples include:
- The TadAZ (Tajik Aluminium Plant) litigation: contractual disputes, alleged fraud and other claims arising out of aluminium production in Tajikistan.
- Weir and others v. The Secretary of State for Transport and Another ("Railtrack"): acted for the Secretary of State for Transport and the Department for Transport in the successful defence of a group action brought by over 48,000 members of the Railtrack Private Shareholders Action Group for alleged misfeasance in public office and breach of human rights in relation to Railtrack plc being put into railway administration in 2001. Gail was the lead assistant solicitor on this case, for which Clyde & Co was short listed for the 'Litigation Team of the Year' award by Legal Week (in 2005) and for the same award by The Lawyer (in 2006).
- Assisted the Treasury Solicitor (on behalf of the Secretary of State for Trade and Industry) in connection with proceedings under the Company Directors Disqualification Act 1986 arising out of the insolvency of a large plc and its group of subsidiary companies.
- The BSE Inquiry: advised and assisted Senior Civil Servants from the then Ministry of Agriculture, Fisheries and Food who were called to give written and oral evidence to this major public inquiry, and to respond to potential criticisms.
- Barlow Clowes: handled aspects of the recoveries exercise and litigation against third parties on behalf of HM Treasury (initially the DTI) following the collapse of the Barlow Clowes group of UK and offshore companies and the Government's ex-gratia payment scheme for investors who suffered as a result of the collapse, in order to recover monies for the public purse.
