International arbitration

With one of the most international dispute resolution practices in the world, our arbitration practice has an outstanding global reputation. At any one time, the Clyde & Co team deals with over 500 international arbitrations all over the world with values running into billions of dollars.

In a recent survey of the most significant international arbitration cases in the world by the publication, The American Lawyer, two of our cases were featured, one being described as 'the largest ICC case'.

Whilst most of our 200 litigation lawyers are well experienced in arbitration, we have a core team of international arbitration experts who are leaders in their field. They work with ease across a wide range of industry sectors and jurisdictions.

Arbitration is the forum of choice for resolving disputes in our main practice areas of commodities, shipping, aviation, transport, energy, international trade and insurance. Other firms may comment on high-profile arbitrations, we actually appear in them. It is, quite simply, what we do. Our lawyers are engaged in major incidents around the world be it an earthquake in Turkey, an aviation disaster, a shipping casualty or a market crisis.

An increasing area of importance in the public international law arena is disputes arising under investment treaties and we act for and against governments in relation to expropriation, fair and equitable treatment, discrimination and denial of justice claims. Public international law is also relevant to our work concerning contract frustration, sovereign immunity, and international debt issues. Many of our high-value arbitrations are international trade-related. We have been panel lawyers to ECGD (Export Credits Guarantee Department) for over 20 years as well as being market leaders in political risk insurance in the private market.

Clyde & Co has recently expanded into China and the US, bringing the total number of our worldwide offices to 18. Our lawyers are also active in jurisdictions where we have no physical presence. This ranges from acting for the Government of Yemen to acting against the government of Azerbaijan to handling international trade BIT disputes involving the Far East, Middle East, Latin America and Africa.

Our lawyers have handled almost every type of international arbitration but most frequently under the following:

  • ICC
  • LCIA
  • SIAC
  • HKIAC
  • Stockholm Chamber of Commerce
  • Uncitral
  • China International Economic and Trade Arbitration Committee
  • GCC Arbitrations in the Gulf
  • Dubai Chamber of Commerce
  • ICSID

We also handle a volume of high-value arbitrations in the fields of commodities, shipping and insurance and reinsurance under RSA, LSA, GAFTA, FOSFA, LMAA, London Metal Exchange, Lloyd's Open Form and ARIAS.
