Clyde & Co’s rail practitioners have been involved in most of the major derailments and disputes in the sector. Covering a range of work, the practice is driven by major groundbreaking work, such as the Bexley derailment; the first major arbitration after privatisation. Our forte is providing a bespoke service for the big one-off case, where the instruction manual has not yet been written.
We handle criminal investigations and prosecutions as well as civil cases. Arbitrations and mediations take up a significant part of our time. We have acted for industry parties, their insurers and their reinsurers in the following rail disasters:
- Ladbroke Grove
- Hatfield
- Bexleyheath
- Camden Road
As well as insurers, our clients may also be rail operating companies and infrastructure maintenance companies. Much of our work is UK-based, but some has an international element.
We defend and pursue claims relating to third parties and also between industry parties. Part of our task in these high-profile and emotive cases is media relations work and negotiation behind the scenes with bodies representing victims and victims families.
