Insurers have succeeded in a complex jurisdictional battle concerning their claims for breach of a settlement agreement governed by English law and exclusive English jurisdiction. The landmark ruling confirms the immediate enforceability, in England, of settlement agreements which have been breached by subsequent proceedings brought by one of the parties in another EU Member State. This Supreme Court judgment relates to the settlement of an insurance claim but the principle extends to English law and jurisdiction agreements compromising claims in any commercial dispute.
