Overview

Clyde & Co will be hosting an in-person seminar at the Doubletree by Hilton Bristol City Centre Hotel on 22 September 2022 at 3pm. The event will feature a panel of lawyers discussing topical issues that will be of interest to those involved in the supply chain at Hinkley Point C.

The event will feature guest speaker guest speaker David Thomas QC, author of the recent edition of Keating on NEC, Matthew Finn of Keating Chambers, together with Peter O'Brien and Victoria Peckett of Clyde & Co. Our panel will help us to explore the practical implications of the following issues under the NEC3 and FIDIC forms of contract:

  • Inflation – Which party takes the risk for an increase in the cost of labour materials and the potential routes for recovering these costs under FIDIC and NEC3
  • Labour shortages – Managing the risks associated with scarcity of labour and material resource
  • Assessing the impact of delay – Considering how to demonstrate delays under the NEC3 particularly if the Accepted Programme is significantly out of date
  • Delay damages – Applying recent caselaw to the enforceability of delay damages and the impact on traditional challenges to these

The panel discussion will be followed by a networking session where refreshments will be provided.
