Nejat advises insurers, cargo interests, shipowners, charterers, port operators, traders, handling both arbitration and court proceedings in various jurisdictions.

Nejat's shipping work focuses on cargo claims and includes a wide range of charterparty and COA disputes including seaworthiness, off-hire, withdrawal from hire, safe port, early redelivery, off-spec bunkers, piracy deviation and oil major approval, as well as ship arrest and maritime casualties. His trade work involves all aspects of sale and purchase agreements for a wide range of commodities. Nejat has experience of drafting and negotiating a variety of logistics and transportation contracts. He is also involved in general commercial litigation.

  • Acting for a UAE based shipowner in defending claims totalling USD 627 million for unpaid and balance hire before the English courts. 
  • Acting for a leading UAE bank in relation to UAE proceedings concerning a USD 600 million international cross-border dispute regarding a number of facility agreements with Saudi based borrowers.
  • Acting for a UAE based company in respect of claims of USD 118 million before the DIFC and English courts. 
  • Acting for a Bahraini pelletizing plant in a LMAA arbitration concerning disputes related to a long term contract of affreightment with a shipowner for shipping iron ore cargoes, defending claims of USD 55 million for unperformed voyages and unpaid deviation costs.
  • Acting for a leading Dutch conglomerate in ICC arbitration in relation to a dispute of Euros 30 million concerning an agency agreement under UAE law.
  • Acting for a UAE based shipowner in a LMAA arbitration defending a USD 30 million claim for outstanding and balance hire.
  • Advising an EPC contractor on a USD 30 million claim following an allision with an oil well in Saudi Arabia. 
  • Acting for a UAE based steel trader in relation to Dubai Court proceedings following the buyers’ defaults under steel supply contracts worth approximately USD 20 million.
  • Advising a UAE based shipowner in defending a USD 17 million claim for unpaid and balance hire before the Hong Kong and English courts.
  • Acting for a UAE based charterer in respect of LMAA arbitrations, defending claims of USD11.6 million concerning the redelivery of time chartered vessels.
  • Acting for a Swiss commodities trader in a UNCITRAL arbitration defending a USD 7.2 million claim for an allegedly off-specification cargo of coking coal.
  • Acting for a UAE based coal trader in a LMAA arbitration in respect of a USD 2.6 million claim for wrongful delivery. 
  • Acting for a UAE based charterer in a USD 2 million demurrage claim before the English courts. 
  • Acting before a US based shipowner in LMAA arbitration concerning claims of USD 1.2m for unpaid charter hire and detention.

Expertise

Nejat is a Senior Associate in the marine team and handles all aspects of shipping litigation and international trade with a focus on cargo disputes. Nejat worked in the Middle East from 2009 to 2019, working in the firm's Dubai and Qatar offices before relocating to join the London team.
