The court overseeing statewide opioid litigation in New York recently made a ruling regarding the manner in which a March 2020 trial will proceed on liability for New York State entities' public nuisance claims against manufacturers and sellers of opioid products. On February 14, 2020, Judge Jerry Gargiulo denied the opioid defendants' request for a unified trial, while also allowing for certain portions of defendants' medical causation defenses to be heard during the trial's liability portion.
