Micaela Pather is a Senior Associate in the Johannesburg office, specialising in insurance law, insurance coverage disputes and complex commercial litigation. She advises insurers, reinsurers and policyholders on policy interpretation, coverage, liability and dispute resolution.
Her insurance litigation experience spans coverage, construction and engineering, professional indemnity, product and public liability, medical malpractice, cybercrime, business interruption and insurance recovery matters. She also advises on contractual disputes, delictual claims and complex, high-value commercial proceedings.
Before joining Clyde & Co, Micaela practised in the dispute resolution and insurance team of a leading South African commercial law firm, Webber Wentzel.
Micaela’s current practice focuses on complex commercial and insurance disputes. She advises clients from the early assessment of coverage, liability and litigation risk through to the resolution of disputes by litigation, arbitration or mediation.

- Fidelity Guarantee – Acting for an insurer in a US$38 million employee-theft claim involving complex coverage issues and policy avoidance arising from non disclosure, alleged breaches of US sanctions.
- Business Interruption – Acted for leading insurers and policyholders in high-value Covid-19 business interruption claims involving indemnity, causation, aggregation and quantum disputes in arbitration.
