The ongoing delay for Scotland’s QOCS review

With Scotland’s QOCS (Qualified One-way Costs Shifting) regime now firmly embedded in Scottish personal injury litigation, questions are growing about whether the balance it strikes is fair - and why a statutory review has not yet been progressed.

Writing in today’s Scotsman, partner Natalie Gibb argues that the delay matters, not least because the review has been required by law since 2023. 

Natalie also considers the contrast in that lack of movement with the Scottish Government’s more recent focus on inflation-linked reforms - for the bespoke Scottish personal injury discount rate setting-process and periodical payment issues, which focus is arguably not urgent at all - and sets out why a QOCS review should have been more of a priority and should now be made a priority.
