Over the past two decades, Abu Dhabi has transformed its legal landscape. What was once a relatively limited forum for resolving complex commercial disputes has evolved into a modern, technology driven court system that supports international business and investment.
In this episode of our Abu Dhabi 20 year anniversary podcast series, we take a closer look at the evolution of the onshore Abu Dhabi courts. Hosted by Keith Hutchison, a commercial disputes partner in our Abu Dhabi office, the discussion brings together fellow Clyde & Co disputes lawyers, Sherif Maher, Alfred Thornton and Jennifer Eakins, with decades of combined experience in the UAE to reflect on how the system has changed and why those changes matter.
Our panel explores the key milestones in the development of the onshore courts, from the establishment of the Abu Dhabi Judicial Department to the move away from reliance on the federal court system and the introduction of specialist civil, commercial and construction circuits. They also discuss the distinction between federal and local courts and how jurisdiction works in practice.
The conversation highlights the courts’ focus on efficiency and access to justice, including the impact of digitalisation, remote hearings and online case management. Changes to court fees, the recovery of court and expert costs, and the introduction of fast track processes such as the small claims court are also discussed, alongside the growing role of mediation and conciliation in resolving disputes earlier.
The episode also considers how the courts have adapted to meet the needs of a diverse and international population, including the introduction of specialist family courts that provide greater certainty for expatriates living and working in Abu Dhabi.
