James Crabtree is an Associate in our Healthcare department. James’ experience covers a range of healthcare advisory work, with a specific focus on patient safety, complex discharges, child safeguarding and the legal frameworks surrounding DNACPR’s, Advanced Decision Notices and withdrawal of CANH. He has also been involved in complex applications to the Court of Protection for serious medical treatment under the Mental Capacity Act and has advised on detention under the Mental Health Act.

James’ experience covers a range of healthcare advisory work, with a specific focus on patient safety, complex discharges, child safeguarding and the legal frameworks surrounding DNACPR’s, withdrawal of CANH and Advanced Decision Notices. James has recently supported an NHS Trust in a complex Court of Protection application seeking declarations that continued Clinically Assisted Nutrition and Hydration (CANH) was no longer in the best interests of a patient in a prolonged disorder of consciousness (PDoC): The Hillingdon Hospitals NHS Foundation Trust v YD & Others (Refusal of Withdrawal of Treatment) [2025] EWCOP 31 (T3)

James has previously advised a number of NHS Trusts on safeguarding children and the application of DOLS, including a reported case which highlighted the national shortage of placements for children with complex behavioral issues: X (Child: Deprivation of Liberty: Lack of Placement), Re [2023] EWHC 3416 (Fam). 

He has also been involved in complex applications to the Court of Protection for serious medical treatment under the Mental Capacity Act and has advised on detention under the Mental Health Act. This has included emergency, out of hours applications. 

Qualifications

Studied Law at the University of Leeds and undertook the LLM at BPP in Cambridge.
