Constance Malleville is a Senior Associate in the Litigation and International Arbitration team in the Paris office. Her practice focuses on commercial and investment arbitration, as well as cross-border litigation.
 
Constance has successfully represented clients in ICC, ICSID, PCA, UNCITRAL and ad hoc arbitrations under a variety of applicable laws and arbitral seats, across multiple jurisdictions, particularly in France, Europe, Eastern Europe and Africa. Her experience spans a broad range of sectors, including construction, defence, high-tech and energy, and includes acting for State-owned entities and sovereign States, as well as corporations and individuals.
 
She is also involved in arbitration-related court proceedings concerning the setting aside and enforcement of arbitral awards in France and abroad.
 
In addition, Constance advises clients before civil and commercial courts in France and internationally, with a particular focus on private international law issues. Her experience includes proceedings relating to the recognition and enforcement of foreign judgments, multi-jurisdictional asset tracing and recovery, fraud litigation, cross-border insolvency matters, the taking of evidence abroad, and the obtaining of conservatory measures in support of foreign proceedings.
 
Constance also regularly acts as arbitral secretary of arbitral tribunals.
 
She is currently Co-Chair of the Paris Very Young Arbitration Practitioners (PVYAP) group.
 
Prior to joining Clyde & Co, Constance trained and worked at several French and international law firms in Paris, with experience in international arbitration, public international law, and civil and commercial litigation.
 
Constance has been admitted to the Paris Bar since 2020. She holds an LL.M. from the London School of Economics and Political Science. She also completed a Master’s degree in International Law from Université Paris II Panthéon-Assas, a Master’s degree in English and North American Business Law from Université Paris I Panthéon-Sorbonne, and a Certificate of Legal Studies from the Institut des Hautes Études Internationales (IHEI) in Paris.

Commercial Arbitration

• Representing a French high-technology and defense company against a major French armaments group in a dispute concerning the breach of a know-how transfer license, which gave rise to several proceedings, including an ICC arbitration governed by New York law and seated in New York, an ad hoc arbitration governed by French law and seated in Paris, and several related set-aside proceedings before French and U.S. courts.
• Represented a Congolese company against a leading Australian mining group in two ICC arbitrations governed by Congolese law and Australian law, seated in Paris, in a dispute concerning the termination of a share transfer agreement.
• Represented a major French construction group against a North African State-owned entity in an ICC arbitration, seated in Geneva, in a dispute concerning the difficulties in performing a public works contract for the construction of a dam.
• Represented a major French construction group against a North African State-owned entity in a UNCITRAL arbitration, in a dispute concerning the difficulties in performing a public works contract for the construction of a dam.

Investor-State Arbitration

• Represented a company incorporated in the State of New York against a Central American State in an ICSID arbitration concerning alleged violations of the investor’s rights under local law and customary international law in relation to his investment in the construction and commissioning of a parking meter system. 
• Assisted in a public international law dispute before the Iran–United States Claims Tribunal.
• Assisted in the representation of an African State against a Cayman incorporated company in an ICSID arbitration, in a dispute concerning the alleged breach and termination of a hydrocarbon production sharing contract governed by local law.

Set aside proceedings of arbitral awards and cross border Litigation

• Representing an Eastern European State against Russia in annulment proceedings against an UNCITRAL investment arbitration award worth 100 million before the Paris Court of Appeal.
• Represented a foreign satellite communications company before French courts in multiple proceedings, in relation to enforcing a foreign arbitral award worth 60 million dollars against a State-owned Russian entity.
• Represented a foreign company in extensive cross border litigation before French courts, involving exequatur and enforcement proceedings relating to a Russian judgment —including real estate seizure measures — as well as actions challenging the purported ownership structure of a property in France, in a context that included sensitive jurisdictional issues.
• Represented a Cypriot company before French Courts to obtain attachments of French properties held via a complex ownership scheme, in an effort to recover a multi-million debt arising out of a fraud scheme committed in Russia (protective seizures, bank account seizures, share seizures, pledge seizures).
