We’re pleased to invite you to an exclusive seminar tailored for cyber insurers and brokers: “Suing the Unknown: Injunctions as a Cyber Risk Response Tool”.

When a data breach occurs, is an injunction worth pursuing? What if the attacker is unknown? What is the purpose of such injunctions? 

Join us for a practical, case-based session examining two of the most significant cyber injunction rulings in Australia: HWL Ebsworth Lawyers v Persons Unknown (2023) and University of Notre Dame v Persons Unknown (2025)

Chaired by Simone Herbert-Lowe, Cyber Partner at Clyde & Co, the session will be led by Tamir Maltz, barrister and counsel in both the HWL Ebsworth and Notre Dame cyber injunction cases.

We’ll explore:

  • Whether (and when) to seek an injunction during a data breach
  • How to pursue legal relief against “persons unknown”
  • The real-world implications for claims and risk management
  • The trade-offs to be considered when deciding to purse or decline to pursue such injunctions
