Dr. Janan Gibbins

Janan practises in aviation, aerospace, oil & gas, international trade, shipping, general commercial litigation, dispute resolution and arbitration. Called to the Bar in 2004, Janan has represented clients ranging from state entities to small companies throughout the litigation process. Some of the ancillary matters to the dispute process that she has advised on include enforcing and challenging arbitration awards, obtaining and defending security for costs orders.

In addition, Janan has a PhD with expertise on Iraq and the Middle East and is the author of “Iraq’s Oil and Gas Industry: The Legal and Contractual Framework”. Janan is able to advise governments and participants in the energy sector on constitutional, contractual and legislative issues.

Experience

• Advising a satellite company on a contractual dispute due to the impact of Covid-19 on the aviation sector including an assessment of technical information.
• Assisting with advice to a FPSO on contractual obligations under a service agreement and tariff payments.
• Assisting a supermajor in London Commercial Court proceedings on the interpretation of contractual and payment obligations following a counterparty's suspected fraudulent activity.
• Advising on the implementation and interpretation of UK and European financial regulation along with the FCA Handbook on insurance, commodities trading and market monitoring, including the implementation of MAR and MiFID II whilst working at the Financial Conduct Authority.
• As junior counsel (to Michael Brindle QC), successful appeal of an arbitration award under s.49 of the Arbitration Act 1996 acting for a Government of India company in a matter relating to the authority of company agents to enter into an arbitration agreement. PEC Ltd v Asia Golden Rice Co. Ltd [2014] EWHC 1583 (Comm)
• Advising on shipping disputes including recap terms, bills of lading, claims for off-hire, dead-freight and demurrage.
• LCIA and LMAA arbitrations relating to vessel damage, seaworthiness and maintenance.
