Jade advises, and acts for, insurers, insureds and other insurance industry participants in relation to insurance claims and commercial disputes.
The core focus of Jade’s practice is professional liability and property risks and she had extensive experience:
advising on policy interpretation and policy response, particularly in respect of construction and energy risks, product liability and recall, business interruption and management liability; and
acting in commercial disputes relating to the liability of professionals and directors and officers, particularly in the mining, construction and energy industries; and
acting for individuals and entities in respect of regulatory investigations and prosecutions.
Experience
Property – advising the underwriters of a contract works policy in relation to their liability to the insured in respect of a number of claims arising out of the construction of a large infrastructure project
Property – acting for underwriters in litigated disputes in Queensland and Western Australia relating to policy response for the loss of mining equipment
Professional liability – acting in the defence of claims against engineering companies in relation to the design and construction of mines in Western Australia and New South Wales
Professional liability – defending a structural engineer in relation to a prosecution by the regulatory authority arising from the collapse of a crane
Professional liability – acting for land developers in defending claims by land purchasers for misleading and deceptive conduct
D&O – acting as defence counsel for a director in relation to a prosecution by the regulatory authority for offenses relating to the contamination of land
D&O – acting as coverage counsel in relation to a claim by shareholders against the directors of a mining company arising from market representations
Product liability and recall – advising underwriters in relation to claims arising from the contamination of cheese products in New Zealand and UHT milk products in Victoria
