Aideen has extensive experience acting for clients across a range of sectors. She has worked on the advisory panel for two multinational companies for several years, assisting with a diverse range of issues from complex disciplinary and grievance processes through to discrimination and contractual obligations.

In recent years, Aideen has successfully defended a large number of unfair dismissal, discrimination and whistleblowing claims both in the Employment Tribunals and in the Employment Appeals Tribunal (EAT), as well as working on several breach of contract claims and injunction applications in the High Court relating to restrictive covenants and confidentiality or fiduciary duties. 

She has also conducted a number of client training sessions on topics such as discrimination, complex disciplinary and grievance procedures, TUPE and performance management

Experience
  • Successfully defending a high value and complex claim of constructive unfair dismissal, race discrimination and whistleblowing in the Employment Tribunal
  • Negotiating advantageous settlement of a multi-party claim regarding changes to terms and conditions, culminating in numerous unlawful deduction of wages and constructive unfair dismissal claims
  • Successfully applying for strike out, deposit orders and costs awards in respect of a number of unmeritorious and / or out of time claims
  • Assisting with an injunction application and breach of contract claim relating to a 'team move' / breach of contractual duties claim, both in the High Court and the Court of Appeal
  • Carrying out two internal grievance investigations for large organisations accused of discrimination 
  • Assisting with a number of complex disciplinary / grievance / whistleblowing investigations and outcomes
  • Advising employers on reasonable adjustments and the issues around managing disabled employees, including those with mental illness
  • Providing advice regarding Sunday working provisions in the retail sector
  • Advising on, drafting and negotiating employment contracts for the full range of employment levels and types
  • Assisting senior executives in reviewing and negotiating restrictive covenants, as well as advising various employers in relation to the same
  • Drafting letters before action and undertakings in relation to alleged breaches of confidentiality provisions and / or covenants of serving and former employees
  • Compiling suites of precedent documents for internal HR use, including disciplinary and grievance outcome letters and summaries of the various stages of a Tribunal claim
