Limitations of liability are often among the most hotly contested aspect of any dispute. Their interpretation can lead to wildly divergent outcomes that can shape the course of disputes.
In this episode, we consider three recent judgments on the interpretation of limitations of liability. The decisions address whether particular clauses provide for one cap or multiple caps, and whether the clause should be applied against parties’ net liability or gross liability.
