Driving under the influence of nitrous oxide: A growing road safety threat

Nitrous oxide – also known as “NOS” or laughing gas – has been the focus of legislative intervention in recent years.
Commonly inhaled using balloons, the immediate effects of nitrous oxide can vary; and include feelings of euphoria, relaxation and detachment. Users may also experience hallucinations and sound distortions, with effects typically lasting for 1 or 2 minutes.
In the context of driving, it is the rapid onset of these effects, combined with impairment of coordination and judgement, that makes nitrous oxide use at the wheel particularly dangerous.
Legal position
As a result of widely publicised concerns regarding the use of nitrous oxide by school age children and young adults, increased instances of drug driving as well as discarded canisters becoming a common sight on streets in England and Wales, nitrous oxide was categorised as a Class C drug in 2023 and its possession where intended for wrongful inhalation criminalised.
Although possession of a class C drug can attract a sentence of up to 2 years imprisonment, financial penalties are generally imposed by the courts for low-level offenders.
The offence of driving or attempting to drive with a specified drug above the specified limit, contrary to section 5A Road Traffic Act 1988, is not applicable to nitrous oxide, with no legal limit for it in breath, blood or urine currently provided for in legislation. Driving whilst under the influence of nitrous oxide does however engage the offence of driving whist unfit through drugs, contrary to section 4(1) Road Traffic Act 1988, with offending drivers liable to receive a maximum sentence of up to 6 months imprisonment as well as a mandatory minimum disqualification from driving for a period of 12 months.
The Sentencing Guidelines for offences relating to serious injuries and death arising from careless or dangerous driving can also encompass use of nitrous oxide at the wheel, with the highest culpability category specifically providing for instances where there has been driving “highly impaired by consumption of alcohol and/or drugs”.
In Court
A number of cases that have come before the courts in recent years demonstrate growing judicial concern surrounding nitrous oxide use whilst driving.
In May 2026, a driver was sentenced to 11 years and 8 months imprisonment at Manchester Crown Court for causing death by dangerous driving. Among the multiple serious aggravating factors present in the case, the driver had been filmed consuming nitrous oxide at the wheel and driving at speeds in excess of 100mph shortly before the collision occurred; described as “utterly shocking” by the sentencing judge.
In July 2025 a disqualified driver received an extended sentence of 16 years and 6 months detention in a young offender’s institution for causing death by dangerous driving; having driven through a red light at speed before colliding with a pedestrian crossing the road, with CCTV cameras capturing him inhaling nitrous oxide from a balloon at the wheel – an act described by the sentencing judge as “exceptionally dangerous”.
A disqualification from driving for a period is 17 years and 8 months, 10 years beyond his anticipated release from custody, was also imposed.
In 2024 a 19 year old driver received a sentence of 9 years and 4 months imprisonment at Oxford Crown Court for causing the death of his three teenage passengers by dangerous driving, with footage of him inhaling nitrous oxide from a balloon prior to the collision recovered from a phone in the vehicle.
Although extreme examples of offending, these cases provide stark illustrations of the danger that consumption of nitrous oxide at the wheel presents.
Emerging enforcement technology
Detection of individuals driving under the influence of nitrous oxide does present a challenge to the police, given the speed at which it leaves the body. Accordingly, prosecutions for driving whist unfit due to nitrous oxide use are generally reliant on circumstantial evidence of its use.
A notable development in enforcement however is the introduction of roadside nitrous oxide detection technology. In May 2026, Hampshire and Thames Valley launched a “world first” trial of a nitrous oxide breathalyser.
Similar to alcohol breathalysers, the portable device is said to be capable of detecting nitrous oxide use up to two hours after inhalation.
With the pilot concluding in June 2026, the results of which are to be reviewed by the Home Office, it is yet to be seen whether such technology will be deployed more widely across England and Wales. If introduced at a national level, the reliability of the equipment will undoubtedly come under significant scrutiny should it be utilised to support prosecutions.
Comment
The classification of nitrous oxide as a Class C drug in 2023 marked clear recognition of its potential harms, and recent high profile cases involving fatalities linked to its use at the wheel clearly highlight the serious risks it poses.
As enforcement measures evolve and public awareness increases, nitrous oxide is likely to remain a central issue in road safety policy and drug driving legislation. Emerging detection technologies, if proven to be accurate and reliable, are likely to be instrumental in enforcement, effective prosecution and in deterrence of drug driving offences involving nitrous oxide.
