Unlike some other jurisdictions, Hong Kong does not currently have a single piece of legislation establishing a comprehensive whistleblower protection regime. Instead, protections for whistleblowers in Hong Kong are found across a range of ordinances. Depending on the circumstances, employees who report wrongdoing may be protected by various statutory provisions, including anti-dismissal protections under the Employment Ordinance in certain circumstances and confidentiality protections relating to corruption reports under the Prevention of Bribery Ordinance.

Whistleblowing policies in Hong Kong

The Hong Kong Independent Commission Against Corruption (ICAC) is developing an Integrity Compliance Management System (ICMS) and related guidance, which it intends to publish in 2026. HKEX's Corporate Governance Code expects listed issuers to establish whistleblowing policies and systems enabling employees and stakeholders to raise concerns confidentially and anonymously where appropriate. This includes ensuring confidentiality and anonymity where appropriate, protecting whistleblowers from retaliation, providing accessible reporting channels, and establishing clear procedures for handling reports and identifying responsible personnel.

Key takeaways

For employers, the greater risk may not be the absence of a dedicated whistleblower law but the failure to maintain robust reporting and investigation procedures. Poorly handled complaints may expose organisations to employee relations issues, employment disputes and regulatory scrutiny. Employers should therefore ensure that whistleblowing policies provide accessible reporting channels, clear investigation procedures and appropriate safeguards against retaliation, particularly in light of increasing corporate governance expectations under the HKEX Corporate Governance Code. Regular training for managers and employees can also help foster a speak-up culture and improve confidence in internal reporting mechanisms.
