Breannon has experience defending claims on behalf of insurers, corporations and government agencies, on instruction from both local and international Underwriters. She has defended matters (including catastrophic claims) in both the District Court and Supreme Court of New South Wales, on behalf of commercial and local government entities utilising the statutory defences of the Civil Liability Act. Breannon has also worked on instruction from injured members of the public, self-insureds and uninsured persons and entities.

Concurrently, Breannon works closely with allied health professionals to respond to and defend allegations of medical malpractice and assists in achieving compliance with regulatory investigations (including the preparation of detailed written responses to the investigating regulatory body, such as the HCCC and AHPRA). Breannon also has expertise in clinical trial/s and claims arising from same (including claims for compensation advanced by patients who develop significant adverse events as a consequence of participation in the clinical trial/s). 

Breannon also acts in commercial matters involving property damage and recovery claims.

Breannon focuses on achieving the best possible outcome for clients through the thorough preparation of matters. She is committed to providing all clients with strategic advice, focussed on early, commercial resolution of claims (where appropriate) and outcomes that are suitable to both the insurer and the insured client.

Breannon is a member of the Australian Insurance Law Association and is an active participant in industry events and seminars. She was a Finalist for the “Insurance” and “Health” categories of the 2021 Lawyers Weekly ’30 Under 30’ awards. 

Experience
  • Acting for a global biopharmaceutical company in relation to a number of clinical trial/s and claims for compensation arising from same;
  • Managing the interests of multiple stakeholders involved in the clinical trial compensation claim process (including Ethics Committees, Medicines Australia, sponsors and sites);
  • Acting on behalf of Local Council/s in respect of large scale, multi-party personal injury claims brought by members of the public (involving other government entities and privately owned corporations as co-defendants);
  • Acting on behalf of allied health practitioners and preparing written responses to the investigating regulatory body regarding allegations of medical malpractice or misconduct;
  • Acting on behalf of contractors in respect of large scale property damage claims, involving damages caused by defectively designed and/or constructed dams, carparks and sprinkler systems.Breannon also has experience in motor vehicle damage claims;
  • Acting in the defence of personal injury claims involving dangerous recreational risk activities, including parasailing, jet boats and segways and involving catastrophic injuries;
  • Acting in the defence of personal injury claims brought against property owners, small business owners, occupiers, managers and security guards, often involving intertwined recovery claims and intentional torts (including s.151Z recovery claims, assault and battery charges and special, aggravated and exemplary damages);
  • Acting for government agencies with respect to public liability claims made by members of the public for injuries occurring on crown land and in local government areas;
  • Advising in respect of personal injury matters arising from injuries upon worksites or shopping centres (involving head contractors, subcontractors and labour hire arrangements) and appearing at contested interlocutory matters and at trial in the District Court and Supreme Court of New South Wales.
