Experience

Directors & Officers – Acting for Underwriters in defence of a policy declinature based on fraudulent non-disclosure in proceedings brought by a liquidator against the former directors of an entity providing short term, low value loans to retail customers

Professional indemnity – Acting for an auditor in defence of a class action for alleged negligence and misleading and deceptive conduct in the production of a report pursuant to the Franchise Code of Conduct

Professional indemnity – Acting for a financial services firm in defence of civil proceedings following fraudulent misappropriation of client shares by one of its advisers

D&O Regulatory investigations coverage – Advising Underwriters as to coverage for regulatory investigations following failure to notify

Financial institutions – Advising primary and excess insurers of one of Australia’s big four banks on coverage for regulatory investigations, civil penalty provisions, and remediation programmes arising out of the Banking Royal Commission
