Kaitlin acts in commercial and professional indemnity litigation. She assists in defending litigated and non-litigated complex common law and statutory liability matters, including, but not limited to, professional indemnity claims against builders, engineers, architects and lawyers.

Kaitlin has experience in managing high value and multi-party complex litigation in the Supreme Court of Queensland and the Federal Court of Australia. She is experienced appearing on behalf of clients in interlocutory applications in the Magistrates, District and Supreme Courts.

Kaitlin has also spent time working in London, gaining experience in both international regulatory investigations and high-profile litigation.

Experience
  • Construction Professional Indemnity – Defending a structural engineering firm in multi-party litigation in the Supreme Court of Queensland arising from an alleged defective design of slabs in residential high-rise towers involving both rectification costs and a claim for liquidated damages.  The claim is for AUD $25 million.
  • Complex Litigation – Acting in a large ACP cladding matter for the building surveyor in relation to a claim for rectification costs for replacing cladding in a landmark commercial building in Brisbane CBD.
  • Construction Professional Indemnity – Defending claims against a civil and structural engineering firm in relation to claims by the head contractor in relation to allegedly defective geotechnical investigations and structural design of a performing arts centre at a Brisbane school.  The claim is for AUD $4 million.
  • Construction – Defending a civil contractor in a claim against it for negligence and breach of contract in respect of alleged defective earthworks in regional Queensland. The claim is for AUD $6 million.
  • Defending unfair preference claims (and other insolvency related claims) to obtain commercially preferable outcomes for clients.
  • Assisted in the successful defence on behalf of directors against a claim brought by ASIC in the Federal Court of Australia for several breaches of directors’ duties.
