Mark Beswetherick is a Partner and Head of Clyde & Co’s Dispute Resolution Group in the Middle East, the leading dispute resolution team in the UAE (and ranked Band 1 by Legal 500).  Mark is recognised by Legal 500 as a “Leading Individual” in the UAE for arbitration and international litigation, noted in particular for his: "professional negligence expertise, representing Big Four accounting firms and elite law firms". 

Mark’s day-to-day legal expertise is in resolving disputes, investigations and litigation involving professional services firms, financial institutions, insurance companies, directors & senior managers. 

Experience
  • Defending negligence claims against a range of professional services firms, including accountants, auditors, consultants, law firms, insurance brokers, technology firms, financial & investment advisers and valuers & surveyors.
  • Advising companies on the handling, and management of, cyber-crime and data breach events, breach response project management, including notifications to data protection authorities and other regulators, instructing and managing IT, forensic and PR firms, defence of resulting third-party litigation, as well as recoveries.
  • Defending investigations by regulators (including the DFSA and QFCRA) and civil litigation against financial institutions and/or their directors and senior managers (in their individual capacities for breach of directors’ duties and/or as authorised/approved individuals).
  • Commercial fraud and white-collar crime litigation and tracing/recovery actions, anti-bribery and anti-corruption advice and conducting internal corporate investigations.
  • Advising insurance companies on a wide range of first and third-party commercial insurance policy disputes and litigation, including: Professional Indemnity; Cyber; D&O; Banker’s Blanket Bond, Electronic & Computer Crime, Fidelity & Commercial Crime; Trade Credit; Specie; Life Insurance mis-selling claims; PAR/BI; Commercial General Liability and Product Liability; a broad range of facultative and treaty reinsurance disputes; and subrogated recovery claims.

Mark has been based in Dubai since 2008 and has extensive experience of litigating in all the major Common and Civil Law dispute resolution forums in the region including the DIFC Courts, QFC Courts, ICC and DIFC-LCIA arbitrations, Dubai & UAE Courts, KSA Dispute Committees, BCDR in Bahrain, as well as regional and international mediations and ADR.  Mark also has significant experience of defending actions before specialist regulatory and disciplinary tribunals in the region.

Qualifications

Mark is qualified in England & Wales and is a Part II-registered advocate in the DIFC Courts.
