Carine is involved in international and domestic arbitrations and litigation in the Australian courts. She also attends to adjudication applications and appeals from, and the enforcement of, such determinations.

Carine has extensive experience in front-end construction work. She has undertaken complex contract negotiations and has drafted a wide range of project documents for the procurement of major infrastructure projects. She advises on the legal and commercial issues which arise during the life of a project including appropriate procurement models, funding models, tender evaluation, risk mitigation strategies, legislative and regulatory issues. She acts for clients in the public, private (including global contractors) and charity sector across a range of industries including mining and resources, oil and gas, port, rail, transport and logistics, primary industry, education, property and social infrastructure.

Carine also has significant corporate advisory experience, including the listing of public companies, fund raising, corporate governance and regulatory compliance, insolvency, reconstruction, recovery and security enforcement.

Disputes

  • LNG Project – Advising the head contractor in relation a large LNG project in Australia, including regarding the international arbitration of disputes and Supreme Court litigation against various major subcontractors
  • Iron Ore Mining Project – Advising an international contractor in relation to adjudications, Supreme Court injunctive proceedings (including for return of securities) and an international arbitration regarding claims arising out of a contract for the construction of structural steel and associated mechanical, piping, electrical & instrumentation works and stockyard facilities for an iron ore mine in Western Australia
  • Offshore Marine Project – Advising an international technology company in a Supreme Court dispute regarding the fabrication of a sub-sea cooling skid for use in an offshore oil & gas development
  • Social Infrastructure – Acting for a global contractor in a domestic arbitration against an architectural practice in relation to the design of a large public hospital in Western Australia
  • Renewable Energy – Advising a leading engineering group in relation to disputes arising out of the detailed design of a Waste Transfer Station in Perth. Disputes concerned liability for design of the bioconversion system and/or liability for construction defects, delays and loss of supply contracts associated with the production of compost as well as biogas for export to the grid as renewable energy
  • Mining railway project - Advising a construction contractor in relation to the recovery of costs against a subcontractor for rectification of defective or unfinished rail signalling and communications works, and related claims associated with a heavy haulage iron ore railway in the Pilbara, Western Australia
  • Rail maintenance dispute - Advising a rail maintenance contractor in relation to Supreme Court proceedings regarding claims for damage and destruction of rail wagons, loss of iron ore freight and associated pure economic loss by a Western Australian iron ore miner arising out of a freight derailment

Transactional

  • Intermodal freight project - Advising a major global contractor in relation to the contracting strategy for a AUD 1.5 billion intermodal rail hub and terminal development in New South Wales including drafting a project supply chain suite of contracts for track signalling, communications and other works associated with rail infrastructure procurement
  • Northlink Road Project (Perth to Darwin Highway) – Acting for  a joint venture in preparing an integrated suite of supply chain agreements for use by the joint venture on the AUD 1.02 billion Northlink Project in Western Australia for the Government of Western Australia (Main Roads)
  • Rail Junction Project – Acting for a global contractor in relation to drafting a project supply chain suite of documents for use on the Torrens Rail Junction Project in South Australia
  • Renewable Energy – Providing advice on an EPC construction contract and other supply and services subcontracts to the head contractor constructing the Nam Lik 1 Hydroelectric Power Project in the People's Democratic Republic of Laos
  • Federal Government Property Management – Acting for a large property management and construction company as primary service provider to a large Australian Federal Government Department outsourcing facilities management, construction and consultancy services for its properties and facilities throughout Australia, including preparing a range of project documents
  • International Fashion Retail – Acting for a high end international fashion retailer in the negotiation and drafting of new commercial tenancy leases in exclusive shopping centres in New South Wales, Victoria, South Australia and Western Australia. Advising the client on the termination of, and exit from in various leases and storage agreements and preparing deeds of variation or surrender and release
  • Public infrastructure – Perth City Link Project - Acting for the Western Australian Government in relation to the AUD 500+ million project to upgrade existing track and station facilities and sink railway lines and a bus station in the city centre, including drafting project alliance agreement, an alliance development agreement and tender documents and advising the Western Australian Government during tender process
  • Ports – Acting for the Dampier Port Authority in relation to a AUD 300 million port expansion including the construction of a seawall, land-backed wharf and ancillary works through dredging and reclamation, including advising on funding options and regulatory issues and preparing consultancy and construction contracts
  • Railway and Port Facilities – Acting for Fortescue Metals Group and its subsidiary, The Pilbara Infrastructure, in relation to the construction and maintenance of 280km heavy haulage railway and associated infrastructure as well as the construction and operation of a new port facility. Preparing draft third party access agreements in relation to usage of the railway and port facilities
