Michelle focuses on coverage advice on insurance and reinsurance contracts and has acted for the Lloyd's syndicates and companies insurance markets since 2000, across a broad range of sectors.
Michelle has particular expertise in the accident & health, contingency and special risks sectors, with considerable experience in PA, sports insurance, event/cast insurance, kidnap & ransom, piracy risks and travel insurance/reinsurance.
Michelle acts in a wide variety of claims from high value, high profile risks, including international arbitration or confidential and commercially sensitive settlements, to lower value and less media sensitive FOS disputes. She has extensive experience of fraudulent claims and surveillance issues.
Michelle's practice includes drafting policy wording/proposal forms with a focus on regulatory compliance, reviewing binding authority agreements or undertaking coverholder reviews, as well as providing specific regulatory advice, particularly on conduct risk and consumer business.
Acting for the market in coverage litigation in relation to a PTD claim for a Premiership footballer with £8m claim for a career ending ankle injury relating to issues of recurrent disability, rehabilitation and causation
Acting for insurers in relation to coverage litigation arising out of a Kidnap & Ransom policy in a dispute valued in excess US$3m regarding non disclosure, interpretation of policy terms and late notification
Acting for the market in relation to a dispute regarding a TTD claim for a Premiership footballer with a club claim in excess of £2m with issues on pre-existing disability and causation
Advising the market successfully on a PTD claim regarding the threshold between illness and accident through the FOS procedure and the Administrative Court
Advising insurers in a variety of "insured person" litigation claims and the scope of cover under K&R policies for legal costs and liability
Advising on a film insurance claim regarding the non completion of a documentary and subsequent recovery
Advising the LMA on accidental death coverage, reinsurance of life insurers and pandemic issues
Drafting new sections of the Lloyd's K Form
Drafting contingency wordings for legal contingency issues
Advising on claims and wordings relating to malaria and tropical disease, particularly in relation to marine and on-land security consultants
Acting for the market on a player's own benefit policy, particularly with reference to degeneration exclusions
