Phillip Coady is a partner in our Projects & Construction team, based in our Sydney office. Phillip has two decades of experience in the construction, engineering and infrastructure sectors, both in-house and in private practice, and advises on the complete lifecycle of construction projects, from project and transactional front-end drafting and advice; project delivery and advisory, to dispute resolution, including litigation, arbitration, expert determination and adjudication.

Prior to joining Clyde & Co in April 2022, Phillip has worked for top-tier legal practices in Australia and the UK. He has also worked as an in-house senior legal counsel for Lendlease Engineering, which was one of Australia’s largest development and construction corporations and has been involved in an array of large-scale projects, disputes, litigation, arbitrations, adjudications, mediations and facilitated negotiations.

Phillip is admitted as a solicitor of the High Court of Australia, Supreme Court of NSW and is also a qualified solicitor in England and Wales. This breadth of experience makes Phillip highly competent to manage a variety of projects in a domestic and international context.

Phillip has been named as recommended construction lawyer in Doyle’s Guide and was nominated for Construction and Infrastructure Partner of the Year in the Lawyers Weekly Partner of the Year Awards 2020.

Experience
  • Acting for a joint venture in respect of the delivery of a multibillion-dollar PPP infrastructure project in Sydney, including providing advice on various legal issues, assisting with downstream contracts, and preparing project management training. 
  • Successfully acted for a tier one contractor in tendering for a project deed for the construction of port infrastructure in Western Australia.
  • Acting for the Alliance on a multibillion-dollar infrastructure project in Brisbane. 
  • Successfully acted for a contractor in tendering for a contract for the construction of a satellite facility in NSW. 
  • Successfully acted for a heavy engineering contractor in proceedings in the NSW Supreme Court against its client regarding the assembly and manufacture of army vehicles (Baker & Provan Defence Pty Limited v Supacat Pty Ltd [2020] NSWSC 0).  
  • Successfully acted for an Italian design consultant who was sued by CPB Contractors in obtaining a mandatory stay to arbitration from the Supreme Court of NSW (CPB Contractors Pty Ltd v DEAL S.R.L. [2021] NSWSC 820). 
  • Successfully acted for Acciona Infrastructure Australia Pty Ltd in proceedings in the NSW Supreme Court in respect of an application to set aside an Adjudication Determination under the Building and Construction Industry Security of Payment Act 1999 (NSW) (Acciona Infrastructure Australia Pty Ltd v Holcim (Australia) Pty Ltd [2020] NSWSC 1330).
  • Successfully acted for Acciona Infrastructure Australia Pty Ltd in an application in the NSW Supreme Court to set aside a statutory demand (In the matter of Acciona Infrastructure Australia Pty Limited [2019] NSWSC 1156). 
  • Successfully acted for a contractor against a Council in proceedings in the NSW Supreme Court regarding unpaid variations and extension of time claims, and two further proceedings regarding challenges to the contractor’s rights under the Adjudication Determination under the Building and Construction Industry Security of Payment Act 1999 (NSW) in which we were successful (Canterbury-Bankstown Council v Payce Communities Pty Ltd [2019] NSWSC 1419; Canterbury-Bankstown Council v Payce Communities Pty Limited [2019] NSWSC 1803). 
  • Successfully acted for an Italian pipeline contractor in an ICC arbitration regarding the construction of a pipeline between Qatar and the United Arab Emirates for the distribution of gas from the North Field in the Persian Gulf.
