Richard is an associate in the marine department of our Brisbane office. Richard has broad international experience advising on shipping, aviation and international trade matters, with a particular focus on marine casualty and commercial shipping litigation matters.

Richard acts for a wide range of clients including shipowners, charterers, cargo interests (both marine and aviation) and their insurers in both contentious and non-contentious matters.

Richard has extensive international marine casualty experience, having investigated and advised on vessel collisions, groundings, and salvage matters. He also has broad commercial shipping litigation experience, having advised on charterparty, sale and purchase, and bill of lading disputes.

His non-contentious experience includes advising on charterparty fixtures and Australian shipping regulatory issues.

Before joining Clyde and Co, Richard worked in a leading London shipping practice for two and a half years, where he gained significant litigation experience including high-profile English High Court proceedings and LMAA, SIAC and LOF salvage arbitrations.

Experience
  • Admiralty Arrests: Arrest of an oil tanker in Queensland on behalf of an overseas towage service provider

  • Charterparties:

    • Advised both shipowners and charterers in relation to both contentious and advisory charterparty matters, including:

    • Advising a leading Australian energy company on chartering LNG vessels

    • Representing a shipowner in complex repudiatory breach of contract claim under LMAA rules

    • Advising an international mining company regarding several disputes arising out of a contract of affreightment

    • Advised a shipowner on the merits of terminating a bareboat charterparty due to complications caused by the COVID-19 pandemic

    • Represented shipowner interests in a complex multiple party charterparty chain dispute stemming from the loss of cargo under LMAA rules

    • Represented charterers in relation to a negligent misrepresentation under LMAA rules

  • Collisions: Represented both shipowners and port terminal interests regarding collisions both in Australia and internationally, including successfully representing an owner in a high-profile collision claim in the English Admiralty Court

  • Marine Casualty Attendance: Advised shipowners in response to marine casualties, including casualty attendance, advising on liability and legal representation

  • Salvage: Represented both shipowners and salvors in LOF arbitration

  • Vessel sale & purchase disputes: Represented the purchaser in a ship sale and purchase MOA dispute regarding seller’s misrepresentation under SIAC rules

  • General Average:

    • Represented a shipowner in a general average dispute with cargo interests stemming from an engine breakdown incident under LMAA rules   

    • Represented a shipowner in a general average dispute following the grounding and subsequent judicial sale of the cargo under LMAA rules

  • Regulatory Advice:

    • Advised a major cruise line in relation to operating out of Australia regarding importation, licensing, crew wage, and maritime jurisdictional tax issues

    • Advised a global financial services group regarding importing, exporting and storing commodities in Papua New Guinea

    • Advised a global mining company on the customs and import requirements on a variety of its freight models

  • Commonwealth Government Investigations: Assisted a shipowner regarding a Commonwealth Government criminal investigation into potential breach biosecurity provisions   

  • Australian Senate Committee Submissions: Drafted senate committee submissions on behalf of a large shipowner regarding proposed changes to shipping regulations

  • Marine Cargo Claims: Advised Australian marine cargo interests in relation to potential claims for delay and damage  

  • Air Cargo Claims: Represented air cargo interests regarding a sizable cargo loss claim  

  • Administrative Review: Assisted a marine service provider regarding the internal review of a Queensland state government decision

  • Australian Consumer Law: Advised a major cruise line in relation to complying with COVID-19 regulations and potential Australian Consumer law claims

  • Marine Liability Agreements: Drafted an exclusion and limitation of liability agreement for an Australian marine engineering service provider regarding the installation of a gear to a vessel   

  • Marine Intellectual Property: Advised an Australian shipwright regarding international copyright and intellectual property claims

  • Jurisdictional Disputes: Advised an Australian marine cargo insurer regarding local jurisdiction issues
