Francesca Fraser is a Senior Associate in Clyde & Co LLP's London office and a member of the International Arbitration team. 

Francesca has broad experience in investment arbitration and international commercial arbitration, under a range of arbitral seats, governing laws and rules of arbitration. Francesca has advised clients and assisted in investor-State disputes at ICSID and under the UNCITRAL rules. In commercial arbitration, Francesca is familiar with all major institutional rules and has particular experience under the ICC, LCIA and UNCITRAL Rules. 

Francesca's practice covers a wide variety of sectors, particularly oil and gas, energy, construction, infrastructure and banking. Francesca has advised on international disputes involving Middle Eastern, African, European and Central and South American parties. Most notably, Francesca has assisted in the representation of a Saudi investor in Hesham Al-Warraq v. the Republic of Indonesia, an investor-state arbitration which set a precedent under the Investment Agreement of the Organisation of Islamic Cooperation, allowing foreign investors to take host states to arbitration.

Francesca is admitted in England and Wales.

Experience

• Advising a UK-based claimant in its US$ 300 million investment treaty claim against a Latin American state (bilateral investment treaty/ICSID).
• Advised on two investor state arbitrations for a high profile dispute relating to financial services under United Kingdom/Indonesia bilateral investment treaty (ICSID) and on Saudi Arabia/Indonesia bilateral investment treaty (OIC)
• Acted as co-secretary of an ICC Arbitration Tribunal, in respect of a US$60million construction claim based in Colombia, with arbitral seat in Houston. 
• Advising a UK-based oil and gas company in its US$60 million investment treaty claim against an African state (bilateral investment treaty/ICSID).
• Advising an Ecuadorian based insurance company in a subrogated claim for its insured relating to the destruction of a power plant in Ecuador (ICC).
• Advised a major investment bank in a payment dispute with a mining company in Mongolia for US$100 million claim (UNCITRAL)
• Advised an EPC Contractor in an US$80million ICC construction claim in Indonesia against the owner. 
• Advised a major oil company regarding US$45million oil exploration rights claim in China (UNCITRAL).
• Advised Austrian company in a US$30million ICC construction dispute regarding ongoing payment and variation disputes based in Saudi Arabia.
• Represented a major energy contractor in two adjudications concerning payment disputes relating to the construction of an energy from waste facility in the U.K.
• Represented an owner in an expert determination against a consortium of contractors on a project based in Saudi Arabia.
• Advised a building materials manufacturer in a crisis management case with respect to its obligations in a government inquiry.
• Advised a Big Four accountancy firm in relation to a professional negligence claim for GBP 116 million brought against them by the Liquidator of a property investment fund in the Isle of Man courts.
