Joshua Henderson, C.S., is a Senior Counsel in our Toronto office. He is a client focused litigator and is fortunate to have had numerous clients trust him with trial and appellate matters, nevertheless, he understands that resolution prior to adjudication is often the best outcome. Joshua was a partner at another insurance firm before joining Clyde & Co in 2021.
Joshua handles a wide range of commercial litigation, insurance defence, professional liability, and coverage disputes and has represented clients at all levels of court in Ontario. He has extensive experience defending commercial and personal injury claims on behalf of insurers, municipalities, and corporations.
Joshua obtained his JD from Osgoode Hall Law School, his B.Sc. from the University of Waterloo, and his ALM from Harvard. He was called to the Bar in 2009 and has been recognized as a Certified Specialist in Civil Litigation since 2017. He has been selected by his peers for inclusion in The Best Lawyers in Canada in Insurance Law since 2020.
Joshua currently teaches Civil Procedure at Lincoln Alexander Law School and has previously taught at the University of Toronto Law School and the Southwest University of Political Science and Law in China. He is the author of numerous articles and textbook chapters and is currently working on publishing his first textbook with LexisNexis.
Experience
- Represented an international motor manufacturer in a mass tort arising from a series of house fires.
- Won multiple jury trials and appeals on behalf of individuals sued in motor vehicle claims.
- Won multiple summary judgment motions on behalf of corporations sued under the Occupiers’ Liability Act and Negligence Act.
- Successfully opposed leave to appeal to the Supreme Court of Canada on behalf of an international car manufacturer.
- Represented various insurers in numerous coverage disputes.
- Represented a large real estate developer in a complex commercial action arising from contaminated soil.
