Arturo is an expert in construction arbitration, with extensive experience advising owners and main contractors. His deep sector knowledge, combined with his experience in construction, real estate, mining and energy projects, enables him to provide a comprehensive approach to commercial and contractual matters, dispute resolution, litigation, and arbitration, as well as risk management and claims prevention.
In the renewable energy industry, Arturo has played a key role in advising owners and main contractors in wind and solar plants, managing EPC, BoP and BoS contracts, among others.
Throughout his career, Arturo has advised clients across the full project lifecycle in Chile, from planning and construction to operation, financing, sale, and decommissioning.
He has also served on the boards of transnational companies in Chile and Peru, providing ongoing counsel to foreign businesses operating in the region. His experience includes advising local and international clients on major transactions, guiding them through the acquisition, development, and financing of real estate and energy projects.
Experience
- Represented the main contractor in a claim for additional costs and overheads arising from the construction of two photovoltaic plants in Chile, securing an arbitral award for the full amount claimed.
- Representing the owner in an arbitration initiated by the EPC contractor regarding the construction of a wind farm, power line, and connecting substation in the Antofagasta region of Chile.
- Representing the contractor in a claim for additional overhead costs and lost productivity during the construction of a shopping mall in Santiago, Chile.
- Advising the main contractor in a complex arbitration before the Santiago Arbitration and Mediation Centre, involving a dispute exceeding US$30 million during the construction of a photovoltaic plant.
- Representing a construction company in arbitration against a real estate subsidiary of an investment fund, involving a dispute valued at US$14 million.
- Representing the Owner in arbitration against an EPC contractor arising from serial defects in the design and construction of two of the largest wind farms in Chile. This matter involved two claims, with a total dispute amount of US$18 million.
- Representing the Owner in two arbitrations brought by an EPC contractor, involving a total dispute amount exceeding US$7 million.
- Advising a main contractor in the installation of a solar plant in the north of Chile with a 126 MW of installed capacity, under a USD 18m contract.
- Advising a main contractor in the construction of wind power stations in the south of Chile with a 73 MW of installed capacity, under a USD 24m contract.
- Advising a main contractor in the construction of wind power stations in the south of Chile with a 108 MW of installed capacity, under a USD 33m contract.
- Advising on the acquisition, subsequent asset management and sale of residential housing.
