Martin Plowden advises clients involved in commercial litigation and insurance-related disputes in a variety of sectors, with a particular focus on the cyber and data privacy sectors. His recent commercial litigation experience includes representing clients involved in breach of contract disputes and actions seeking injunctive relief in both federal and state courts in California. He also represents US and Lloyd’s of London insurers involved in complex coverage disputes, including in defense and in subrogated recovery actions.

Regarding cyber, Martin advises clients dealing with data breach incidents, including the monitoring of third-party lawsuits and regulatory investigations which often arise as a result of such incidents. The data breaches which Martin routinely works on involve high profile incidents impacting the personal information of millions of individuals, as well as highly confidential investigations conducted by regulatory authorities in both the US and abroad.

With respect to data privacy, Martin advises clients on how to comply with the ever-evolving area of US state data privacy laws, including but not limited to, the California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (“CPRA”). As a dual-qualified attorney licensed in both California and the UK, Martin is also experienced in advising clients on compliance with the EU General Data Protection Regulation (“GDPR”) and the UK GDPR. His compliance advisory work pertaining to cybersecurity includes advising clients on the legality of ransomware payments and the legality of port scanning. Additionally, he has provided non-contentious data privacy advice by drafting the US Privacy Policy and California Privacy Notice for an e-commerce client.

Martin is a fully proficient Spanish speaker having lived and worked in Spain.
