Eric Retter

Eric Retter focuses his practice on advising insurance carriers regarding coverage. Eric is a member of the North American FIDO/Professional Liability Practice Group. He has a diverse range of experience representing clients through the litigation process and has significant experience in state, federal, and appellate courts. Eric has successfully resolved insurance disputes through litigation and mediation in cases involving professional liability, property damage, business income losses, general liability claims, and employment practices. He has also counselled insurers as monitoring counsel and is familiar with advising carriers on their rights and duties with regards to both primary and excess policies.

Previously, Eric worked at a national firm and advised clients in a number of industries, including hospitality, residential complexes, restaurants, and construction. 

Before entering private practice, Eric served as a law clerk for Chief Judge Federico A. Moreno in the US District Court for the Southern District of Florida and as the staff attorney for Judge Aaron B. Mason in the State Court of Clayton County, Georgia.

Experience

• Obtained summary judgment in the US District Court for the Middle District of Georgia for insurer on claim for damage to commercial property. The Court held that Plaintiff had not presented admissible evidence that the alleged damage arose out of a covered event sufficient to trigger coverage.  
• Obtained summary judgment in the US District Court for the Northern District of Georgia on behalf of insurer on all claims including breach of contractual obligations in matter arising out of water loss at Plaintiff’s home on the grounds that Plaintiff failed to satisfy a condition precedent to suit under the policy. 
• Obtained summary judgment in priority of coverage dispute between insurers in the US District Court for the Northern District of Georgia arising out of a shooting that occurred at the premises of a mutual insured. 
• Obtained summary judgment in declaratory judgment action brought by insurer in the US District Court for the Northern District of Georgia. The Court held that the insurer had no duty to defend or indemnify its insured for an incident that occurred on the insured’s premises.
