Jennifer is Special Counsel and specialises in complex insurance coverage issues, particularly in relation to financial institutions, corporate misconduct and shareholder disputes. Jennifer has advised insurers in relation to numerous class actions, regulatory proceedings and large-scale customer remediation programs in the financial services sector. Her experience also extends to advising on privacy liability, cyber incident response and emerging risks in the FinTech space. Jennifer is also an experienced commercial litigator and has successfully defended a wide range of professionals in litigated claims (including accountants, financial planners, building certifiers, engineers and solicitors). In particular, she has extensive experience in handling claims against professionals in the financial services sector. |
Experience
- Financial Institutions – Advising primary and excess insurers across multiple major banks and financial institutions on regulatory investigations, civil penalty proceedings, class actions and remediation programs arising out of the Banking Royal Commission.
- Securities Class Action – Acting for primary and excess insurers in relation to three securities class actions arising after the collapse of an ASX-listed engineering company.
- Directors’ and Officers’ Liability – Advising primary insurers in relation to the coronial inquest and statutory investigations following the death of four patrons at a theme park owned by an ASX-listed leisure management company.
- Cyber and Privacy Liability – Advising insurers in relation to a series of large-scale cyber incidents and the associated notification and remediation programs.
- Financial Institutions – Acting for London and US-based insurers of an Australian-owed foreign bank in relation to a large-scale customer remediation program for the mis-selling of loan products.
- Directors’ and Officers’ Liability - Advising the insurers of an ASX-listed gaming and entertainment group in relation to multiple shareholder class actions and regulatory investigations.
- Professional Liability – Defence of accountants, engineers and building certifiers in proceedings brought in the Supreme Court of Queensland for negligence and breach of contract.
