Owen has thirteen years of experience in litigation and arbitration, acting for both claimants and defendants in commercial disputes, across a wide range of jurisdictions, sectors, and practice areas, including financial services litigation, group litigation, construction litigation, professional negligence, “lost litigation”, insurance and reinsurance disputes, discrimination, defamation, insolvency and fraud.

Owen regularly acts for insurers and reinsurers, City law firms and barristers, Big 4 Accountancy Firms, design and construction professionals, financial institutions, commercial property firms, and educational providers. 

Prior to joining Clyde & Co, Owen acted for Sir Alan Bates and 554 postmasters in their successful group action against Post Office Limited in respect of the defective accountancy software, Horizon, uncovering what many have described as the “worst miscarriage of justice in British legal history” and which led to unprecedented legislation to overturn nearly 1,000 unsafe convictions and a statutory inquiry into the scandal. Owen also acted for pensioners and retail investors in claims against banks, financial advisers and pension companies, resulting in a Court of Appeal authority establishing duties owed by pension companies to de-frauded pensioners. 
 

Experience
  • Advised on contractual interpretation and aggregation under reinsurance treaties in relation to Ukraine war-related losses and conducting intensive fact analysis of claims across jurisdictions.
  • Advised the insurer and reinsurers of one of the world’s largest professional service firms on a portfolio of claims and regulatory investigations in multiple jurisdictions, and advises on policy wording and insurance regulatory obligations across jurisdictions.
  • Defending High Court claims bought against City law firms and barristers in respect of 'lost litigation' cases brought by their former clients, including claims relating to the outcomes of interim applications such as strike out, security for costs and freezing injunctions, undersettlement of underlying litigation claims, and claims relating to allegedly defective advocacy and representation in criminal prosecutions.
  • Defending a claim against construction professionals, including a High Court claim against a cavity wall insulating company in respect of an apartment complex that it was alleged needed to be re-built as a result of the method of insulation used, and an arbitrated claim concerning the specification and installation of combustible cladding in a hospital.
  • Defending a conservation architect in respect of allegedly defective restoration of a historic monument.
  • Defending claims against conveyancing professionals in relation to lease extensions and negotiations, ground rent clauses, conflicts of duty, and reports on title.
  • Defending claims against colleges and universities relating to allegedly negligent teaching, breaches of safeguarding duties, discrimination, harassment, copyright infringement and complaints to the OIA.
