Katie has advised and acted for insurers, insureds, government departments and corporate clients in both State and Federal jurisdictions. Her experience includes defending litigated and non-litigated claims against directors and officers, corporate trustees, financial advisers, architects, building surveyors, real estate agents, mortgage brokers and other professionals. She has advised clients on complex and non-complex indemnity and liability issues.

Katie has acted for life insurers and trustees in litigated disputes on claims for total and permanent disablement benefits, salary continuance benefits, trauma benefits, and death benefits in both the retail and group life contexts. She has advised clients on complex claims involving fraud and non-disclosure.

Katie has experience acting for medical practitioners, allied health professionals and private hospitals involved in a coronial inquest or investigation. She also has experience as part of a team acting for a major life insurer in the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry, and for a major party before the Royal Commission into Institutional Responses to Child Sexual Abuse.

Katie's 'front end' experience includes advising insurers on their policy wording, risk management and claims handling processes.

Experience
  • Property damage – Advising and defending a statutory authority in proceedings issued in the Supreme Court of Victoria by the owner and operator of a gold mine relating to a large property damage claim. The claim involved consideration and analysis of complex geotechnical expert evidence.
  • Life insurance – Advising and defending a major life insurer on a claim for a death benefit under a retail policy which involved complex fraud and non-disclosure issues.
  • Personal injury – Advising and defending the landlord of a property in multi-party proceedings issued in the Supreme Court of Victoria involving a catastrophic personal injury claim.
  • Directors and officers – Advising and defending the CFO of an agribusiness company against cross claims filed by the auditors of the company, in multi-party proceedings issued in the Federal Court of Australia. The auditors alleged the CFO breached reasonable care and diligence obligations owed to the company under s.180 of the Corporations Act 2001 (Cth). The claim settled favourably for the CFO following opening submissions from Senior Counsel on the first day of trial.
  • Employment practices liability – Advising and defending a primary school and former school principal against allegations of unlawful discrimination under the Equal Opportunity Act 2010 (Vic).
  • Coronial inquiry – Acting for a registered health professional in a coronial inquiry involving the death of a newborn child.
  • Policy review – Advising a major London insurer on policy wording and amendments to its living benefits policies. This included an assessment of legal and litigation risk and providing general risk management advice.
  • General liability – Assisting a major insurer with its internal dispute resolution responses on indemnity on a range of property damage and motor vehicle accident claims.
