Madelaine acts in complex commercial litigation including large professional indemnity claims, claims arising out of large corporate insolvency events and alleged market misconduct, and contentious coverage matters. She predominately acts for directors and officers, professionals, and insurers in relation to large financial losses. Her disputes experience spans the Federal Court, the Supreme and the District Court of New South Wales.
Madelaine has also acted for a range of professionals (including solicitors, accountants, architects, engineers and financial planners) on professional indemnity matters.
Experience
- Defending professional indemnity claims for professionals including solicitors, financial planners, accountants, architects, and engineers, with issues of apportionment between multiple parties to the proceedings.
- Advising on complex pre-litigated coverage disputes in relation to financial institutes and more broadly D&O and PI coverage investigations.
- Monitoring class actions for primary and excess insurers, including coverage advice for complex disputes,
- Advising reinsurers on Treaty interpretation, as well as providing advice as to breach and quantum of said Treaty breach.
- Acting for insurers in litigated coverage disputes and assisting clients to achieve early commercial resolutions.
- Defending unfair preference claims (and other insolvency related claims) to obtain commercially preferrable outcomes for Insureds and Insurers.
