Trained as a shipping and international trade and commodities dispute resolution practitioner, Toby has since developed a broad practice in litigation and arbitration across various sectors, with a particular focus on shipping, international trade and commodities, shipbuilding, cross-border insolvency and shareholder disputes.
Toby has assisted both local Chinese and international clients in arbitrations conducted under the HKIAC, LMAA, SIAC, ICA and ICC Rules as well as ad-hoc arbitrations. He also has experience in handling matters at various levels of the Hong Kong Courts.
Given Toby’s dual-qualified dispute resolution background and bilingual skills, he is regularly retained by clients to advise on commercial agreements, including contract review and participating in commercial negotiations.
Toby has spent a number of years in Shanghai and is experienced with advising clients on cross-border matters specifically involving issues in both Hong Kong and PRC.

Acting for a leading Chinese information technology company in a substantial cross-border M&A dispute subject to SIAC arbitration involving a claim in the region of USD200 million.
Advising and assisting a PRC oil refinery company in a SIAC arbitration involving a cargo off-specification claim against seller.
Represented a leading Chinese shipyard in an LMAA arbitration against shipowner in relation to a building quality dispute.
Advised and assisted a PRC state-owned entity in multi-jurisdictional insolvency proceedings involving a sum over USD25 million.
Advised and assisted a PRC state-owned entity in defending a guarantee dispute subject to HKIAC arbitration.
Assisted one of the largest pool management companies globally in the enforcement of a LMAA arbitration award in Hong Kong.
Advised and assisted a reputable Chinese media company in a shareholders’ dispute subject to HKIAC arbitration.
Advised and assisted a Chinese electronic display company in a cross-border shareholders’ dispute subject to HKIAC.
Assisted a leading Chinese bank in a security enforcement dispute in the Hong Kong courts.
Advising shipowner and charterers on various charterparty disputes on a regular basis.
