Melissa is an experienced insurance litigation lawyer.

Melissa has a special interest in Health Law and Life Sciences.

She acts for a range of registered health practitioners including pharmacists, physiotherapists, acupuncturists, chiropractors, Chinese medicine, psychologists, nurses and osteopaths in claims for injuries allegedly arising from negligent treatment. 

Melissa also represents registered health practitioners in complaints made to the Australian Health Practitioner Regulation Agency (AHPRA), Office of the Health Ombudsman, Health Complaints Commissioner and Health Care Complaints Commission, as well as in Medicare and coronial investigations and inquests.

In addition, Melissa acts for registered building practitioners including architects, building surveyors and builders, along with property managers and project managers for negligent provision of services.

Her public liability practice involves defending a wide range of global corporations, local businesses and governments in claims involving ‘slip and trips’ and various other circumstances.

Experience
  • Defending a number of health practitioners in claims involving acupuncture needles, dispensing errors, failing to refer patients to other health practitioners and various other circumstances.  Melissa has experience with defending nervous shock claims.
  • Assisting a pharmacist in a coronial inquest arising from a dispensing error.
  • Assisting various health practitioners in responding to complaints about privacy breaches, requests for medical records under the Health Records Act 2001 (Vic), capacity to practice, advertising, boundary transgressions and compliance with the AHPRA codes of practice. 
  • Involved in the Appeal of the Lacrosse cladding matter in Victoria.
  • Defending building surveyors in claims relating to alleged negligent issuing of building permits.
  • Defending corporations and local governments in claims involving slips and trips in car parks, shopping centres, office buildings, parks, on footpaths and pit lids, extraction of patrons from premises, entrants to faulty elevators and in various other circumstances.
