3 June 2025

What has been announced?

US tariffs

  • On 28 May 2025, the US Court of International Trade ruled that the US government’s emergency “liberation day” tariff scheme was ‘unlawful’ and granted a request for a preliminary injunction on the collection of tariffs.
  • The Court stated that the International Emergency Economic Powers Act 1977 did not enable the President to “unilaterally impose, revoke, pause, reinstate, and adjust tariffs to reorder the global economy”.
  • The ruling of the US Court of International Trade has, however, been stayed for a period of 14 days to allow the US government time to seek review in the Washington DC Circuit Court of Appeals. During this period of the administrative stay, the US’s current tariff regime will stay in effect.
