In this next episode of our Abu Dhabi 20 year anniversary podcast series, we focus on arbitration and mediation, and how both have evolved to become central pillars of dispute resolution in the emirate.
Hosted Keith Hutchison, partner in our Abu Dhabi office, the discussion brings together Clyde & Co disputes lawyers Alexandra Lester, Alfred Thorton and Jennifer Eakins, to reflect on how arbitration in Abu Dhabi has developed from its early institutional roots into a framework that now competes confidently on the international stage.
The episode traces the evolution of arbitration in Abu Dhabi, from the original Abu Dhabi Commercial Conciliation and Arbitration Centre to the launch of the Abu Dhabi International Arbitration Centre, arbitrateAD, in 2024. Our panel explains why the new rules represent a significant step forward, including greater procedural flexibility, expedited proceedings, emergency arbitrator provisions and a clearer alignment with international best practice.
The conversation also explores how arbitration operates across both onshore and offshore systems. The panel considers the interaction between arbitrateAD, the Abu Dhabi Global Market, or ADGM, and the onshore courts, including the role of the ADGM as the default seat of arbitration and the increasingly supportive approach of both court systems to the arbitral process, from interim relief to recognition and enforcement of awards.
Drawing on practical experience, the episode highlights how technology is shaping arbitration in Abu Dhabi. The introduction of digital case management platforms and world class hearing facilities has transformed how proceedings are run, improving efficiency, transparency and access for parties and tribunals alike.
The discussion then turns to mediation, a form of dispute resolution that has historically been underused in the region but is now gaining real momentum. The panel examines recent legislative reforms, court backed mediation initiatives and cultural shifts that are driving greater acceptance of mediation as a cost effective and efficient way to resolve disputes, particularly as the nature of disputes in Abu Dhabi continues to diversify beyond traditional construction and real estate matters.
Taken together, the developments in arbitration and mediation reflect a broader commitment to providing businesses with a wide range of credible, flexible and modern options for resolving disputes in Abu Dhabi.
