Rishabh Agny's practice focuses on insurance coverage and coverage litigation, representing insurers in challenging first-party matters and complex third-party claims and lawsuits. Rishabh regularly defends insurers against allegations of bad faith, breach of contract, and negligence, as well as claims brought under Washington’s Insurance Fair Conduct Act (IFCA) and Consumer Protection Act (CPA). He is also skilled in distilling complex coverage issues into clear, practical coverage opinions that support informed claims handling and claims/litigation strategy.

In a regulatory environment where missteps can quickly lead to exposure, Rishabh provides insurers with pragmatic, forward-looking guidance. He routinely counsels insurers on risk transfer and risk management strategies, helping clients navigate coverage disputes while minimizing litigation and regulatory risk. His approach emphasizes clarity, strategic judgment, and a deep understanding of Washington’s punishing insurance landscape.

Prior to joining Clyde & Co, Rishabh advised insurers in third-party claims in almost all of the 50 states, with a focus on mobility and cyber risk, where he provided coverage guidance on emerging and evolving exposures. This experience informs his current practice, allowing him to bring a broad, national perspective to complex coverage disputes and insurer counseling matters.

• Litigated multi-jurisdictional UIM bad faith dispute with significant exposure. (ongoing)
• Litigated contribution action between client (CGL carrier) and co-insurer (PL) in large-scale construction dispute and following a Stowers demand (Texas), resulting in a favorable outcome at mediation (Voyager Indemnity Insurance Company v. Houston Specialty Insurance Company, Case No. 4:22-cv-02763 (S.D. Tex. 2022)
• Guided insurer in anticipating insured’s arguments for coverage in a mall shooting, including consideration of covered “occurrence” under CGL policy. (2025)
• Advised insurer in complex construction dispute involving recalcitrant co-insurers. (2025)
• Advised insurer in aviation related rescission issue involving a misrepresentation about the hull’s condition and prior losses. (2026)
