Kyle’s practice is primarily focussed on construction matters. He has acted for domestic and overseas insurers, and on behalf of building professionals and engineers, both locally and abroad. 

Kyle frequently manages litigated and unlitigated professional indemnity claims against construction and engineering professionals, and regularly provides advice on complex coverage issues relating to construction matters. Kyle also has experience in defending professional negligence claims brought against brokers and underwriters.  

Kyle is admitted to practice in Australia and South Africa. Whilst practicing in South Africa, Kyle was recognised for Construction Law (2022) and Litigation (2021 – 2022) in Best Lawyers. 

Kyle also has experience as an in-house legal counsel for a large multinational company operating in the waste, water and energy industry. 

Experience
  • Professional indemnity: Acting on behalf of design engineering joint venture in court proceeding relating to a motorway upgrade in Queensland, with allegations of design, construction, and maintenance defects 
  • Professional indemnity: Acting on behalf of architects, engineers and superintendents in claims for breach of professional duty relating to non-compliant cladding being installed on the facade of several residential towers in NSW.
  • Professional indemnity: Acting on behalf of structural engineer in arbitration proceedings relating to claim for defective structural design services on public infrastructure project in Western Australia. 
  • Professional indemnity: Acting on behalf of underwriter in court proceedings relating to alleged breach of binder. 
  • Insurance coverage: Acting as coverage counsel in respect of various claims made against developers and builders relating to building defects in developments located throughout Australia.
