Alex regularly acts for EC, motor and public liability insurers in defending personal injury and employees’ compensation claims and has experience in advising policy-related issues such as policy coverage, double insurance, contractual / policy indemnity clauses and repudiation of policy liability due to breach of policy terms.

Experience

• Acting for EC insurer of a security company in a fatal claim when the Deceased found dead in the course of employment at the place of work. Successfully argued that the Deceased died not because of an "accident" and resisted the claim for EC compensation
• Acting for Intended Defendant in a personal injury claim (involving assault) in which the Claimant formulated his claim on occupiers' liability. Successfully argued that the Intended Defendant's duty should be restricted to the "state of the premises" and the Claimant dropped his claim against the Intended Defendant
• Acting for The Motor Insurers’ Bureau of Hong Kong for numerous personal injury cases arising from motor accidents following the provisional liquidation of Anglo Starlite Insurance Company Limited
• Advising insurer on a block insurance policy covering public liability, employees’ compensation and group personal accident taken out by the Education Bureau of the Hong Kong Government for aided and Caput schools
• Acting for Defendant in a personal injury claim in a horseback riding accident involving highly complicated and technical issues. The case involved issues on contributory negligence and legal points on voluntary assumption of risk
• Acting for Defendant in a personal injury claim brought in the High Court involving a plaintiff acting in person with long medical history. The only issue in dispute was quantum and pleaded claim exceeded $40m. The Court eventually allowed an award of below $200K
• Acting for insurer of a security service contractor in a claim involving personal injury at work.  Advising on contribution issue against the co-defendant being the property manager. Successfully sought contribution from the co-defendant
• Acting for insurer of a swimming pool cleaning contractor in a personal injury claim arising out of a slip and fall accident. Advising on double insurance and contractual indemnity issues.  Successfully sought the principal / its insurer to take over the conduct
• Acting for EC insurer for an industrial accident happened on board of a vessel. Advising on policy coverage and successfully avoided the policy on grounds of misrepresentation and material non-disclosure
