Morgan is a Legal Director in our Energy & Construction team. He joined our Cape Town office in January 2021. He qualified as an attorney in 2013 and has experience both in the courts of Johannesburg and Cape Town.
He has acted for a wide range of clients across various industries, including mining houses, EPC contractors, piling and lateral support contractors, civils and earthworks contractors, logistics companies, lessors of plant and heavy machinery, universities, accounting firms, insurers and reinsurers, loss adjusters, underwriting managers, franchisors, hotel chains, professional associations and provident funds.
He has also drafted and advised on the terms of bespoke construction contracts, EPC and O&M contracts, plant hire contracts, performance bonds, deeds of surety, confidentiality and non-disclosure agreements, supply contracts and general trading terms.
Morgan is part of a global team that handles construction and engineering disputes in various jurisdictions, including Africa, the Middle East, Europe and Australia.
Experience
- Acting for major UAE contractors in various DIFC-LCIA and DIAC arbitrations involving ultra-luxury residential, high-rise and retail developments.
- Providing advice on the terms of an EPC Agreement and Power Purchase Agreement relating to the establishment on a 128MW hybrid energy project in South Africa.
- Acting for the main contractor in a UK TCC case related to alleged defects in the construction of a major waste-to-energy gasification powerplant in the city of Hull.
- -Representing a prominent platinum mining company and its subsidiaries in various adjudication proceedings instituted in terms of the provisions of the NEC3 Engineering and Construction Contract.
- Acting for a leading Broadcast and IT Systems Integrator in a dispute with an international news and documentary broadcaster, in relation to a complex broadcast infrastructure and IT transformation project in the Middle East.
- Representing numerous piling contractors in High Court as well as arbitration proceedings involving payment disputes, delay claims and final account disputes.
- Representing both insurers and insured in litigation arising out of “All-Risks” insurance policies, including CAR policies.
- Providing technical and coverage advice to a major global insurer in relation to complaints/claims arising from UK building defects insurance policies.
