Eugene has considerable experience in both disputes and transactional/advisory work, focusing on the engineering, infrastructure and construction sectors across a number of jurisdictions. He has worked extensively on various construction and projects related matters in Indonesia since 2010 and spends a regular amount of time in Indonesia.

He has represented clients in matters involving FIDIC, PSSCOC SIA and REDAS forms of contract.

Eugene has appeared as counsel in every level of the Singapore courts, from the state courts to the court of appeal. He also advises and represents clients in arbitrations under ICC, SIA, SIAC, VIAC and ad hoc rules as well as in adjudications under the Building and Construction Industry Security of Payment Act.

Eugene also advises on the review, drafting and negotiations of engineering, procurement and construction contracts and their related agreements including performance bonds, warranties and parent corporate guarantees. He has also contributed to the Singapore Public Sector Construction Contract: Commentary on the Public Sector of Construction (7th Edition) textbook, and Law and Practice of Construction Contracts (5th Edition).

Eugene was appointed as a Senior Accredited Specialist in Building and Construction Law, by the Singapore Academy of Law in its inaugural batch of accredited specialists. He is recognised as an expert in construction and infrastructure matters by The Legal 500 Asia Pacific and Who's Who Legal for Construction. Experience
  • SIAC arbitration – Acting for the owners in a SIAC arbitration under ICC rules for an estimated claim of USD 200 million following the termination of an EPC contract for a coal-fired power plant in Indonesia.

  • SIAC arbitration – Acting for the contractor in multiple multi-partied arbitrations against the owners of a mining plant  in Indonesia and its equipment suppliers

  • VIAC and SIAC arbitration – Acting for the contractors in various arbitrations arising out of disputes in the Ho Chi Minh Metro Project.

  • ICC arbitration – Acting for a Korean contractor against its design consultants in an ICC arbitration for a claim of USD 39 million arising from an engineering design liability dispute over the Taiwan High Speed Railway.

  • ICC arbitration – Acting for a joint venture of contractors in an ICC Arbitration in a claim for USD 17.3 million arising over a DAB award and disruption and prolongation claims in the construction of a gas pipeline in Indonesia.

  • Singapore Court of Appeal – Acting for the contractor in the Singapore Court of Appeal, successfully appealing and reducing the payable damages to SGD 321,000 which is 96% lower than the original amount of SGD 8.15 million. [2008] 2 SLR(R) Wishing Star Ltd v Jurong Town Corp

  • Singapore court – Acting for one of the project managers in a 43-day trial involving the collapse of the bar chairs system at the Fusionpolis Project, and successfully made a no-case to answer submission which secured the project manager's acquittal. [2007] SGDC 142 Public Prosecutor v Chan Heng Chye and Others.

  • Singapore courts and arbitration – Acting for various contractors against their ready mixed concrete suppliers in both the Singapore courts and in arbitration for claims of frustration and force majeure arising out of Indonesia's ban on the export of sand to Singapore. The value of the claims ranged from SGD 1.6 milion to SGD 8 million.

  • Construction of desalination and power plants – Acting for Hyflux Ltd and its subsidiaries in a PPP project to construct a 318,500 m3/day (water) desalination plant and 411 MW combined-cycle gas turbine power plant in Singapore. Work included the drafting and negotiations for the EPC contract, O&M contract and LTSA agreement of the power plant

  • Construction of a biotechnology facility plant – Acting for the owners in the drafting, advising and negotiations of the construction management, construction and procurement contracts for the building of a USD 500 million biotechnology facility plant in Singapore.
