As Managing General Agents across Europe face increasingly complex and localised regulatory requirements, Clyde & Co has worked with FASE - the pan European federation representing MGAs - to help develop a new interactive map that brings key rules and requirements together in one place.
At present, MGAs seeking to grow across borders must navigate a complex patchwork of regulatory requirements, with rules and expectations varying significantly between national markets. For many firms, particularly those without extensive in-house regulatory or compliance teams, understanding how those rules apply across different jurisdictions can be a significant operational and strategic challenge.
The new online map, available through FASE’s members’ portal, equips members with a practical country-by-country overview of the regulations, regulators and key requirements relevant to MGA operations. FASE approached Clyde & Co's UK and EU insurance regulatory teams to support the project, drawing on expertise from lawyers across seven European markets.
Initial content for the map developed by Clyde & Co covers both well-established and developing MGA markets, including Germany, France, the UK, the Netherlands, Spain, Italy and Poland. There is scope for further European markets to be added as the resource develops, and in response to MGA feedback.
The initiative builds on Clyde & Co’s wider partnership with FASE and draws on the firm’s experience advising MGAs, capacity providers and insurance businesses on regulatory developments, cross-border distribution, governance and emerging regulatory risk across Europe.
Eva-Maria Barbosa, Partner in Clyde & Co’s Munich office and Global Chair of the firm’s Corporate & Advisory Group, said: “MGAs are an important and growing part of the European insurance market, but cross-border growth brings added complexity. Requirements can vary significantly from country to country, making it vital for MGAs to understand the regulatory landscape in each market they operate in or plan to enter.
“Our collaboration with FASE turns Clyde & Co’s cross-border regulatory insight into a practical resource for its members. The new map provides a clear, accessible overview of the key requirements affecting MGAs in different European markets and is designed to help them make more informed decisions as they grow.”
William Pitt, FASE’s Executive Director, added: “Our members have told us repeatedly that understanding and complying with national regulatory requirements is one of their biggest concerns as they seek to expand across borders. We are very grateful to Clyde & Co for sharing its knowledge and insight on this critical issue with our members.”
