Clyde & Co team in Los Angeles has secured a complete victory for clients in a California jury trial involving a high-value property dispute.
The case centered on allegations that the clients' landscaping obstructed a neighboring property's panoramic view in breach of the community's Covenants, Conditions, and Restrictions (CC&Rs). The claimants also alleged private nuisance. The firm's clients disputed those claims and pursued cross claims relating to harassment, invasion of privacy, and intentional infliction of emotional distress.
Following a jury trial, the jury found in favor of the firm's clients on every claim and cross claim. The jury also concluded that the claimants had acted with malice, fraud, and oppression.
Following a separate punitive damages phase, the court awarded the firm's clients a total of USD 1.125 million in non-economic and punitive damages, together with approximately USD 250,000 in attorneys' fees.
Alison Beanum, Partner, led the representation, supported by Margaret Ukwu, Senior Associate, who second chaired the trial and played a key role throughout the proceedings. Margaret examined multiple witnesses and contributed to all aspects of trial preparation and presentation. Her advocacy and ability to respond effectively to developments during trial were integral to the successful outcome.
