Full Profile

Sultan Al-Oqaili is an associate in the Dispute Resolution practice in the Riyadh office, with five years of expertise in both regional and international litigation and arbitration. He has effectively represented clients through various levels of the Saudi judicial system, from initial court proceedings to appeals before the appeal courts and supreme courts, including general, commercial, and labor courts, as well as the Saudi Board of Grievances.

Beyond litigation, Sultan advises clients on legal issues related to Shari'a, commercial, and labor disputes. He has significant experience in both ad hoc and institutional arbitration and is skilled in enforcing foreign awards and judgments in Saudi Arabia. He is knowledgeable about the procedural rules of the Saudi Center for Commercial Arbitration (SCCA).

Additionally, Sultan negotiates contract terms and handles the drafting and reviewing of service contracts, lease agreements, and construction contracts. He is bilingual, proficient in both Arabic and English, which enhances his capabilities in legal drafting and negotiation.

Sultan is a Saudi qualified lawyer eligible to appear before the Saudi judicial bodies.

Experience

Experience gained with Clyde & Co: 

• Successfully defending a leading construction client in a nullification of arbitration award before KSA Commercial appeal courts by dismissing the application and upholding the arbitration award. 
• Successfully defending a major automotive company in a claim before KSA commercial courts for alleged faults of their vehicle by dismissing these claims and getting the judgment upheld by appeal commercial courts. 
• Securing successful arbitration award for a major real estate developer and operator in an SCCA arbitration in relation to damages claim arising from a lease agreement.
• Advising a multinational construction company on KSA tender procedures and the application of assumption under Government Tenders and Procurement law. 
• Advising a client on deduction of fines under the Government Tenders and Procurement law. 
• Advising a leading service provider in the hospitality sector on a personal damage claim. 
• Advising a leading service provider in the hospitality sector on defamation claims under Saudi laws. 
• Advising a client on non-renewal of fixed terms contract under KSA Civil Transactions Law and/or commercial agency. 

Experience gained prior to joining Clyde & Co: 

• Local Arbitration – Successfully representing client in their claim before the Saudi Commercial Centre for Arbitration, seeking circa SAR 500,000 in debt recovery.
• International Arbitration – Successfully defending a claim before an Ad-hoc arbitration tribunal amounting approximately in USD 140 million.
• Debt recovery – Successfully representing client before the Saudi Commercial courts in recovering the claimed debt amounting in USD 2 million.
• Representing clients before the General Secretariat of Committees for Resolution of Securities disputes and its appeal committee.
