Magdalena Wątroba is an experienced commercial litigation attorney-at-law (PL. radca prawny) with a history of working in several international law firms, for the last 15 years. Magdalena is a counsel in the Warsaw dispute resolution team since January 2024.

She is experienced in dispute resolution at both the trial and pre-trial stage. She specialises in representing clients in all types of commercial court cases with a particular focus on: contract & damages, unfair competition, product & professional liability, personal goods and civil disputes with a regulatory component. 

She advises clients in various industries, including: energy, telecom, IT, FMCG and media. She specialises in non-standard ways of obtaining temporary orders and on securing non-monetary claims.

She is also involved in pro bono activities. 

She is admitted to Warsaw’s professional bar (Okręgowa Izba Radców Prawnych) since 2013.
 

Experience
  • Contract performance - court dispute for the determination of the power supply agreement’s content (incl. temporary order to maintain the energy supply until the end of the proceedings).
  • Damages - litigation on behalf of an automotive manufacturer for more than PLN 30 million in a damages’ claim against an insurer.
  • Damages - representing an automotive manufacturer in litigation for damages against the energy provider for incorrect parameterisation of the energy meter.
  • Personal goods - various court disputes for protection of personal goods (board members, politicians, public figures), including rectification of inaccurate press publications and damages.
  • Damages (breach of competition law) - representing a cable network operator in a landmark court dispute with a competitor for damages for breach of competition law (overpricing).
  • Unfair competition - representing a chemical company in a court dispute for damages for an act of unfair competition (customer acquisition).
  • Product liability - representing a food manufacturer in a cross-border product liability dispute (value of dispute: circa USD 30 million).
  • Product liability - representing a pharmaceutical manufacturer in litigation for compensation for side effects of a drug.
  • Professional services - representing a consulting company in a reputation-sensitive dispute for malpractice.
