Sindy Yeung

Full Profile

Sindy joined Clyde & Co in 2021 and is a Senior Associate of the Marine and Dispute Resolution team. She specialises in commercial and shipping disputes and has extensive experience in complex litigation as well as arbitration cases in Hong Kong and internationally. Her practice focuses on the shipping, international trade, energy and commodities sectors, covering charterparty claims, carriage of goods by sea or air, bunker claims, and sale of goods disputes.

Sindy has acted for clients in both ad hoc and institutional arbitrations, including arbitrations conducted under the HKIAC, UNCITRAL, LMAA and SIAC Rules. She also has experience in making urgent applications to obtain interim measures from the court / tribunal such as injunction, asset preservation order, search order, prohibition order, and arrest of vessel. 

Sindy frequently advises and represents clients in settlement negotiations and mediation, assisting them in achieving practical and commercially sensible outcomes.

In addition to civil disputes, Sindy handles criminal defence work and assists clients in responding to investigations by authorities. She has advised on cases involving stowaways, suspected dangerous drugs found on board a vessel, suspected strategic commodities detained by the Customs, investigations arising from a fatal workplace accident etc.

Sindy also provides legal support to conglomerates and companies across a wide spectrum of matters, including regulatory and compliance requirements, licensing, employment matters, contract review, personal data privacy protection, and competition law issues.

Sindy holds a Bachelor of Laws degree from the University of Warwick and Postgraduate Certificate in Laws from the University of Hong Kong.  She is qualified as a Solicitor in Hong Kong in 2020.

Sindy is fluent in English, Mandarin and Cantonese.

Experience

Commercial disputes

• Obtained an award of over RMB9 million plus compound interest for a UAE company in HKIAC administered arbitration proceedings concerning disputes over travel services agreement.
• Represented a global logistics company in HKIAC arbitration against a major airline for alleged breaches of aircraft charters with a value in excess of USD 5 million.
• Acted for a major Chinese technology company in ad hoc arbitration in Hong Kong against an international construction company arising out of the construction of a data centre.
• Defended a corporate jet company against claims under aircraft management agreements.
• Acted in SIAC administered arbitral proceedings in a contractual dispute involving a major logistic and supply chain company.  
• Obtained Norwich Pharmacal orders against banks and liquidators for disclosure of documents for tracing assets.
• Advised a bunker company on New York arbitration and Hong Kong court proceedings regarding a claim of over USD1.4 million for allegedly off-spec bunkers.
• Represented various companies in Hong Kong court actions against former directors for breaches of fiduciary duties.

Shipping disputes

• Acted for a crew manning company and successfully obtained an arbitral award of more than USD 4 million against the shipowners in a Hong Kong arbitration.
• Secured a Mareva injunction for a UK energy company from the Hong Kong Court in aid of London arbitration for charterparty disputes set against the backdrop of EU sanctions on Russian entities.
• Advised an energy conglomerate on claims arising from force majeure notices issued under FOB contracts in connection with the Middle East hostilities.
• Assisted a charterer in dealing with cyberfraud incident and shipowner’s claim for non-payment of hire.
• Acting for global container leasing groups in claims for detinue and conversion of containers leased to a shipping company which went into liquidation.
• Assisted a bunker seller in reaching a settlement with supplier and buyer in respect of alleged claims for off-spec bunkers.
• Represented shipowners, charterers and cargo interests in various charterparty and contract of carriage disputes.

Regulatory & criminal matters

• Advising conglomerates on regulatory and compliance matters arising from their day-to-day business operations and transactions (e.g. licensing, personal data & privacy, employment, competition law issues etc.);
• Assisted a shipowner in dealing with stowaways and suspected drugs found onboard a Hong Kong-flagged vessel;
• Accompanying clients to interviews by authorities and advising on departmental summonses.
